By filling out and sending this form I have digitally signed and agreed to the following terms and conditions. Terms and Conditions of Hire These Terms and Conditions of Hire are between Drivers Unlimited (hereinafter called “the Supplier”) and its client (hereinafter called “the Hirer”) taking on hire from the Supplier the services of a member or members of the Suppliers work force (hereinafter called the “Temporary Worker”). These Terms and conditions, along with the Terms of Trade Contract represent the entirety of the agreement between the Supplier and the Hirer . 1/ Engagement of the Temporary Worker and/or digital signing of this application and agreement by the Hirer shall be deemed an acceptance by the Hirer of these Terms and Conditions and the attached Terms of Trade Contract. 2/ The Hirer shall pay the Supplier an hourly rate for the Temporary Worker and any other agreed expenses directly to the Supplier. There is a 4 hour minimum charge per worker per day. Should the Hirer wish to terminate the Temporary Worker for any reason, the Hirer shall notify the Supplier immediately. 3/ The Temporary Worker shall be under the direction and the control of the Hirer from the time of commencement of duties for the duration of the engagement. The Hirer is responsible for all acts, errors or omissions whether wilful or negligent or otherwise of the Temporary Worker and the Supplier does not accept any liability for any loss, expense or damages arising from any failure by the Temporary Worker howsoever arising. 4/ The Hirer shall ensure compliance with all statutory requirements relating to the Temporary Worker except where these are expressed to be the responsibility of the Supplier under these Terms and Conditions of Business. 5/ The Hirer acknowledges that the charges by the Supplier mainly represent monies already expended by the Supplier and are payable by the Hirer within 3 working days of receipt of a tax invoice or as otherwise agreed between the Hirer and the Supplier. The Hirer acknowledges that should the Supplier be required to take steps to recover any debt owed to the Supplier by the Hirer, the Hirer shall be liable for all costs incurred by the Supplier in recovery of such debt including any costs incurred on a solicitor or own client basis. 6/ Temporary Workers supplied by the Supplier to carry out the work shall at all times be self-employed contractors to the Supplier not employees of the Hirer and the Supplier shall be responsible for all payments required by law to be paid by a Supplier in respect of such persons. 7/ Site supervision is the responsibility of the Hirer. It is the responsibility of the Hirer to provide a safe work site and to ensure that all work is carried out in a safe and responsible manner and that all lawful requirements are complied with. The Hirer warrants the inclusion of the Temporary Worker in all the Hirer’s workplace health monitoring programmes. 8/ Site supervision is the responsibility of the Hirer. The Hirer warrants that they will: a) Take all practicable steps to ensure the Temporary Worker is not harmed while at work b) Induct the Temporary Worker into the safety requirements of their workplace before the Temporary Worker begins work. c) Ensure that the Temporary Worker is not harmed by any hazard that is or arises in the place of work, and have in place a system to effectively manage any hazards under their control. d) Ensure all work is carried out in a safe and responsible manner, providing adequate supervision and training, and appropriate safety gear where required to by law and that all lawful requirements are complied with. e) Include the Temporary Worker in all the Hirer’s workplace health and safety monitoring programs, and insures the Supplier against any claim the Temporary Worker, and/or ACC or MBIE may make in regards to unsafe workplaces, practices or accidents. 9/ Should the Hirer choose to employ the Temporary Worker within a period of 4 months from the last introduction by the Supplier, the Hirer shall be liable to pay the Supplier a fee equal to 200 hours of the Temporary Worker. Charging of this fee shall be at the discretion of the Supplier. 10/ The Hirer accepts that the Supplier may conduct a credit check on them (including any Director and/or Shareholder of the Hirer in the case of a limited liability company) with the Supplier’s nominated credit reporting agency, and that the Supplier will give the Hirers personal information to their nominated agency, who will hold that information on their systems and may share that information with other clients as allowed by law. 11/ The Hirer accepts that if payment obligations are defaulted, information concerning that default may be given to the Suppliers nominated collection agency, where, in the normal course of the nominated agencies business this information may be given to other customers. In the event of any payments owing by the hirer are defaulted an interest rate of 3% shall apply plus all costs of recovering the debt owed by the hirer.
